Community Rules


Covenant Conditions & Restrictions (CC&Rs)

Our community rules are made up of a combination of self-governed, state, county, and city property laws.  These rules serve the purpose of keeping our community safe, preserving the value of our property, and maintaining a standard of living that makes our neighborhood thrive as a community. The following CC&Rs have been compiled by reviewing city, county, and state property management laws, mandates and restrictions. They are in accordance with the City of Winter Park, Orange County, and State of Florida Code Enforcement.

1. Homeowners are responsible for the upkeep of their homes, and yards; including the aesthetic appearance of their homes. 

2. If a homeowner or their renters are participating in illegal activity, please contact Winter Park Police Department and the HOA immediately. The state of Florida reserves the right to seize the property of home owners whose property is being used for illegal activities. 

3. Homeowners who rent out their property must submit a Renter’s Declaration Form to the board as soon as possible, preferably within 30 days of the rental lease signing or tenant moving in.

4. All homeowners must submit an updated information form to the board. If your contact information changes please notify the HOA right away.

5. As a community we must keep a watchful eye on the empty homes. Watch for vandals, thieves, suspicious activity around them, etc. If you see anything unusual please call Winter Park Police Department and notify the HOA. The upkeep of empty homes directly affects the property value of the surrounding homes.

6. We have a no loitering policy. If you see someone or a group loitering please call the Winter Park Police Department, and send the HOA board an email or letter with the information so that we can document it as well. A trespassing warrant can be issued if the problem persists.

7. Winter Park Oaks will follow Orange County, FL curfew laws pertaining to minor children. Children 16 years old and under cannot be outside (hanging out, etc) between 11:00 pm and 5:00 am Sunday through Thursday; Fridays, Saturdays and holidays from Midnight to 6:00 am. A driver under 17 years old cannot operate a motor vehicle between the times of 11:00 pm and 6:00 am unless accompanied by an adult. 

8. Homeowners are free to donate their time, effort, and resources to community projects. However, before starting a project please be sure that the community agrees with it, and that it is approved by the HOA board. It is imperative that homeowners check with the board first to see if funding is available to reimburse them or if they can be given an HOA fee credit of any sort. 

9. According to Florida statute 720.303 HOA voting rights of a homeowner will be suspended if they are not in good standing with regard to dues/fees and any money owed to the HOA.

10. Winter Park Oaks HOA reserves the right to enforce a Special Assessment to each homeowner if the board sees fit. (For example causing damage to a neighbors property or common area.)

11. HOA annual dues of $100 USD are due June 1st of every year starting this year of 2014. Payments are only to be made out to and sent to:

On the 15th day of June if the dues are not paid in full there will be 25% late fee added to your total fees. If your HOA dues are 30 days late there will be another 25% late fee added to your total fees plus any fees incurred for filing court/legal documents, postage and other costs affiliated with  delinquency collection efforts.


12. If you are unable to attend meetings, minutes can be requested in writing via email or hand written letter. 

13. A report detailing how the HOA Board has allocated funds will be provided quarterly to home owners, even if no money has been spent during that quarter.  

14. We ask that residents respect a quiet time in our community from 9:00 pm until 7:00 am Sunday - Thursday, and 2:00am - 7am Fridays & Saturdays (Orange County can fine $1000-$3000 for violations of noise and disturbance ordinances.) We are considerate of the celebration of holidays and special events. If you plan to host a party, a friendly heads up to your neighbors is appreciated.  Neighbors should be able to respectfully let each other know if they are being a little loud, however if you do not feel comfortable approaching a neighbor, please call or email the HOA and we will issue a warning. A 2nd violation will lead to a fine of $25 from the HOA and a 3rd violation will result in a call to the Winter Park Police Department. 

15. Any homeowner that witness another homeowner's pet urinating/defecating on another homeowners lawn/yard/driveway can report it to the HOA board. The following fees will be assessed onto the pet’s owner:
  • 1st Offense: HOA issued written warning  
  • 2nd Offense: $25 fine issued by the HOA (payable immediately)
  • 3rd Offense: $50 fine issued by the HOA (payable immediately) and the HOA will turn the complaints over to code enforcement or the appropriate agency where a stiffer fine will be added. (Orange county can charge $125 or more for violations.)
  • 4th Offense: The pet will be permanently banned from the Winter Park Oaks Community immediately.
16. New community rules can be made upon request of the community as a whole and/or approval of the HOA Board.
